These Terms of Business govern the relationship between Pure Estates and its clients. By instructing us, you agree to be bound by these terms.

Introduction

These Terms of Business set out the basis on which Pure Estates provides letting, management, valuation, and related property services to landlords, tenants, and other clients. Please read these terms carefully before instructing us. If you have any questions, please contact us before proceeding.

Instruction & Authority

By instructing Pure Estates, you confirm that you are duly authorised to enter into this agreement and that all information you provide to us (whether in writing, verbally, or via our website) is accurate, complete, and not misleading. You further confirm that you have the legal right to let, manage, or sell the property (as applicable) and that no third-party restrictions prevent us from acting on your behalf. We rely on the accuracy of your instructions and information; any inaccuracies may result in delays or additional costs for which we shall not be liable.

Property Marketing

Property descriptions, photographs, floorplans, videos, virtual tours, and all marketing materials are produced by Pure Estates for guidance purposes only and do not form part of any contract or warranty. While we take reasonable care to ensure accuracy, no reliance should be placed on such information, and you should satisfy yourself by physical inspection or independent advice. Pure Estates reserves the right to use professional photography and floorplan services, and to list properties on portals including Rightmove, Zoopla, and OnTheMarket. Marketing may be withdrawn or amended at our discretion.

Fees

All fees payable to Pure Estates are agreed in writing prior to instruction (whether via a fee note, letter of engagement, or schedule of charges). Fees become due and payable upon tenant introduction, exchange of contracts, or completion of the relevant service, as specified in your written agreement. Fees are exclusive of VAT where applicable. If you withdraw your instruction after a tenant has been introduced or an offer has been accepted, you may remain liable for the full fee. Rent Collection

Where we act as rent collection agent, payments to landlords are made via bank transfer. Rent is normally remitted to the landlord within 3 working days of receipt from the tenant, provided cleared funds have been received. In some cases (e.g., non-cleared cheques or international transfers), payment may take longer. Landlords must provide accurate bank account details, and we shall not be liable for delays caused by incorrect information or third-party banking systems. All rent statements are sent by email unless you opt out in writing.

Anti-Money Laundering (AML)

In accordance with the Money Laundering, Terrorist Financing and Transfer of Funds (Information on the Payer) Regulations 2017, Pure Estates is legally obliged to verify the identity, address, and (where applicable) source of funds or wealth of our clients. We may use electronic verification systems and/or request original documents such as passports, driving licences, bank statements, and utility bills. We will not proceed with any letting or management instruction until satisfactory evidence has been provided. All information is processed in compliance with UK GDPR.

Valuations

Any market valuation or rental assessment provided by Pure Estates (whether verbal or written) is an estimate only and is not legally binding. Valuations are prepared based on local market knowledge, comparable evidence, and professional judgement. They do not constitute a formal survey or structural appraisal. You are advised to seek independent valuation or survey advice before making financial decisions. Pure Estates accepts no liability for any loss or damage arising from reliance on a valuation provided for marketing or guidance purposes.

Liability

To the fullest extent permitted by law, Pure Estates shall not be liable for any indirect, special, incidental, or consequential loss, loss of income, loss of profit, loss of business, or loss of anticipated savings arising from the use of our services or reliance on any information provided, whether in contract, tort (including negligence), or otherwise. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability which cannot be excluded by law. Our total aggregate liability to any client in respect of all claims arising in any twelve-month period shall not exceed the total fees paid to us during that period.

It does not constitute professional advice, and you should not rely upon it without seeking independent verification. We may update or change the website content at any time without notice. You must not misuse our website by introducing viruses, trojans, or other malicious material, nor attempt unauthorised access to our systems. Any breach of this provision may result in legal action.

Data Protection

All personal data collected by Pure Estates is handled in strict accordance with UK GDPR and the Data Protection Act 2018. Complaints

If you are dissatisfied with any aspect of our service, please refer to our Complaints Procedure, which is available on our website. We are committed to resolving disputes fairly and efficiently. Should your complaint remain unresolved after our internal process (including receipt of our final viewpoint letter), you may refer the matter to The Property Ombudsman within 12 months of our final response. This independent redress scheme is free for consumers and binding on us where you accept the award.

Governing Law

These Terms of Business and any non-contractual obligations arising from them shall be governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales. If you are resident in Scotland or Northern Ireland, you may also bring proceedings in your local court.
